INDEPENDENT SUB-CONTRACTOR AGREEMENT
1.Relationship
- The Sub-Contractor is engaged as an independent Sub-Contractor and is not an employee, partner, or agent of the Business Owner.
- The Sub-Contractor is solely responsible for their own taxation, superannuation, insurance, and any other business obligations under Australian law.
2. Scope of Services
- The Sub-Contractor will provide cleaning, rubbish removal, or other agreed services as arranged by the Business Owner, on a per-job basis.
3. Tools & Equipment
- The Sub-Contractor will supply all tools, equipment, cleaning products, and transport necessary to perform the services, unless otherwise agreed in writing.
4. ID Verification Clause
- The Sub-Contractor must provide valid government-issued photo identification (e.g., driver’s licence, passport, or proof of age card) prior to commencing services, for compliance purposes.
5. Payment
- The Business Owner will pay the Sub-Contractor per job at a rate agreed before commencement of each job.
- The Sub-Contractor must submit an invoice upon completion of each job.
- Payment will be made within 2 business days of receiving a valid invoice.
- ShineEase reserves the right to withhold payment only for disputed or incomplete work until the issue is resolved.
6. Insurance
- The Sub-Contractor must maintain Public Liability Insurance with a minimum coverage of $5 million and provide a certificate of currency upon request.
7. Standards & Conduct
The Sub-Contractor agrees to:
- Perform all services in a professional, safe, and timely manner, maintaining a high standard of quality.
- Notify the Business Owner immediately if unable to attend or complete an assigned job.
- Provide photographic evidence of completed work when requested.
- Not solicit, accept, or perform work directly for clients introduced by the Business Owner without prior written consent.
- Accept full responsibility for any damage caused during the provision of services by themselves or their staff and must cover associated repair/replacement costs.
- While working on ShineEase jobs, the Sub-Contractor must not promote, advertise, or offer their own services to ShineEase clients, either directly or indirectly.
- Comply with ShineEase’s Service Guarantee policy:
- If a customer reasonably identifies areas within the originally assigned and cleaned spaces as not meeting agreed standards, the Sub-Contractor must rectify the issue within 24–48 hours at no additional cost. OR
- For pest control services, rectification may include re-treatment of affected areas as required under the agreed service warranty.
- If the Sub-Contractor fails to rectify the issue, ShineEase may deduct up to AUD $100 from the Sub-Contractor’s payment for that job.
8. Termination
- Either party may terminate this Agreement at any time by providing 7 days written notice.
- ShineEase (Business Owner) reserves the right to terminate immediately if the Sub-Contractor engages in misconduct, fraud, negligence, breach of confidentiality, or a serious breach of this Agreement.
- In cases of serious misconduct or repeated breach, the Sub-Contractor may be liable to pay a penalty fee of up to AUD $500 and may be permanently removed from ShineEase’s Sub-Contractor pool.
9. Entire Agreement
- This Agreement constitutes the entire understanding between the parties and supersedes all prior discussions or arrangements.
- Any amendments or variations must be in writing and signed by both parties to be valid.
